Judge Panepinto’s ruling defers to the actions and decisions of the ZBA and dismisses our appeal in its entirely with prejudice.
While it is impossible not to be disappointed, the fight is far from over. We have contacted Mr. Lippes and are weighing our legal options.

**January 26, 2017 | Hearing Update**
Thank you to everyone in the neighborhood who joined us at the January 26, 2017, hearing. Your presence helped demonstrate to Verizon, Public Storage, and the Town of Amherst that our community is united about preserving and protecting our area’s parklands and local wetlands.
The result of the January 26, 2017, hearing: Decision Pending
Judge Panepinto spent over an hour listening to the arguments from both sides. She then determined that she required more time to consider everything before issuing her ruling. So unfortunately, all we can do at this point in time is wait for word of her decision. We were told by Mr. Lippes that this could take a few days or a few months.
